General

1.   The Learn & Earn With Whirlpool (the "Contest Sponsor") Sweepstakes (the "Contest") will begin on June 1, 2006 at 12:00:01 am ET and will end on November 30, 2006, at 11:59:59 pm ET (the “Contest Closing Date”). Monthly draws will be held from the entries received by 11:59:59 pm ET on the last day of the month (the “Monthly Closing Date).

2.   Before entering the Contest, each entrant must review and agree to be bound by the Contest Rules and Regulations as set out below.  By entering the Contest, entrants accept and agree to be bound by the Contest Rules and Regulations, and accept the decisions of the independent contest judging organization and Contest Sponsor as final and binding in all respects.

Eligibility

3.   The Contest is open to all legal residents of the 50 United States and the District of Columbia and to all legal residents of Canada (excluding Quebec) who are over the age of majority at the time of entry.  Employees, representatives, agents, shareholders, officers and directors and the advertising or promotional agencies of the Contest Sponsor and employees, and those with whom the above are domiciled, are not eligible to enter.  This Contest is void outside the jurisdictions listed above and where prohibited by law.

4.   By entering the Contest, each entrant consents, to the extent permitted by law, to the use of his or her name, image, voice, likeness, city of residence and/or photographs without compensation in any publicity or advertising carried out in any medium worldwide by the Contest Sponsor and/or its advertising or promotional agencies without limitation or further notification, except where prohibited by law.

How to Enter

5.   No purchase necessary.  All eligible entries will be entered in a random monthly draw. The Contest can be entered by one of the following methods:

(a)   enter online by going to www.aecdaily.com and complete any online course and getting a passing grade on the test associated with the course; or

(b)   enter by mailing in a handwritten 20 word or more essay on the benefits of AEC DAILY’s Online Learning Centre, along with your name, address and phone number to:

6.   All entries must be received by the Monthly Closing Date and prior to the Contest Closing Date to be eligible for the monthly draw.

7.   The Contest Sponsor is not responsible for entries that are incomplete, illegible, lost, late, mutilated, misdirected, or postage due, irregular, have been submitted through illicit means, or do not conform to or satisfy any condition of these Contest Rules and all such entries shall be disqualified.  No mechanical reproductions of entries allowed.  Limit of one entry per postmarked envelope.  Limit of one entry per person per eligible course.  Contestants taking online courses must ensure that their online profile is complete and accurate (including name, email and mailing addresses, and telephone number) in order to be considered an eligible entrant.

8.   All entries become the sole property of the Contest Sponsor and none will be returned.

10.   Odds of winning depend on the number of eligible entries received.

11.   The Contest Sponsor, in its sole discretion and subject to applicable law, reserves the right to substitute any portion of the Grand Prize for something of equal or greater value if the advertised Grand Prize or any portion thereof becomes unavailable.  The Contest Sponsor reserves the right, in its sole discretion to terminate or suspend the Contest, or modify the Contest Rules and Regulations at any time for any reason whatsoever.

12.   Grand Prize must be accepted as awarded.  Except as identified above, no substitutions will be made.  Grand Prize may not be sold, transferred or assigned, and is not convertible to cash.

13.   The Draw: On or about 9:00 am ET, in Newmarket Ontario, two (2) weeks following the Monthly Closing Date during the contest period, the Draw for the Grand Prize will be conducted by the contest judging organization from among all eligible entries received through both entry methods combined, by the Contest Closing Date.

14.   The selected entrant will be notified by telephone within approximately 3 (three) days of the Draw ("Notification").  The Contest Sponsor assumes no responsibility for any inaccurate or incorrect information provided to it, or that results in any way from the transmission, receipt or processing of entries.  If the first selected entrant does not respond to the Contest Sponsor within ten (10) days of first contact, the Contest Sponsor shall have the right to disqualify that entrant and to randomly draw another eligible entry. By entering, you agree that if you are a selected entrant that is disqualified and the Grand Prize is forfeited for any reason, the Contest Sponsor shall be fully and completely released and discharged from any liability or responsibility in this regard.  Contest Sponsor is not responsible for the failure for any reason whatsoever of selected entrant to receive Notification.

15.   Upon Notification, the selected entrant, if a Canadian resident, must, unaided, correctly answer a time-limited mathematical skill-testing question.  In the event that a selected entrant is unable to answer the skill-testing question correctly, the Contest Sponsor shall have the right to disqualify said entrant and to randomly draw another eligible entry, and the Contest Sponsor shall be fully and completely released and discharged from any liability or responsibility in this regard.

16.   If a selected entrant is not eligible or does not otherwise meet the requirements as set out in these Contest Rules, the Contest Sponsor shall have the right to disqualify said entrant and randomly draw another eligible entry for purposes of awarding the Grand Prize, and the Contest Sponsor shall be fully and completely released and discharged from any liability or responsibility in this regard.
General Conditions

17.   By entering the Contest entrants, selected entrants, (or their parent/legal guardian in the case of a minor) agree to release and hold harmless the Contest Sponsor, its directors, employees, officers, agents and affiliates, including, without limitation, its advertising and promotion agencies, the prize suppliers, the independent contest judging organization ("Promotional Parties") from any injury, loss or damage of any kind to persons or property, including but not limited to death, resulting in whole or in part directly or indirectly from the acceptance, receipt, possession, use or misuse of the awarded Grand Prize, and portion of the Grand Prize, participation in any Contest-related activity or any travel related thereto.

18.   By entering the Contest, the selected entrant agrees to sign and return the following to the independent contest judging organization within fourteen (14) days of Notification:

(a)   A form affirming eligibility and compliance with all Contest Rules (form may require notarization);
(b)   A liability release form releasing the Contest Sponsor, their directors, employees, officers, agents and affiliates, including without limitation their advertising and promotion agencies, the prize suppliers, the independent contest judging organization; from all liability arising from or relating to the acceptance, receipt, possession, use or misuse of the awarded Grand Prize, any portion of the Grand Prize, participation in any Contest-related activity or any travel related thereto.
(c)   A publicity release form permitting the Contest Sponsor to use his or her name, image, voice, likeness, city of residence and/or photographs without compensation in any publicity or advertising carried out in any medium worldwide by the Contest Sponsor and/or its advertising or promotional agencies without limitation or further notification, unless prohibited by law.

19.   The Contest Sponsor reserves the right, in their sole discretion to terminate or suspend the Contest, or modify the Contest Rules and Regulations at any time for any reason or should fraud, virus, bugs or other causes beyond the control of the Contest Sponsor corrupt the administration, security or proper play of the game.

20.   The Contest Sponsor shall not be liable for any human or technical errors that may arise or occur in connection with the Contest.  The Contest Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of the entries.

21.   The Contest Sponsor is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any e-mail or entry to be received by the Contest Sponsor as a result of technical problems, human error or traffic congestion on the Internet or at any website, or any combination thereof, any injury or damage to the entrant’s or any other person’s computer related to or resulting from participation or downloading or accessing any materials in this Contest.

22.   The Contest Sponsor reserves the right at its sole discretion to disqualify any individual who tampers with or attempts to tamper with the entry process. CAUTION:  ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW INCLUDING CRIMINAL PROSECUTION.

23.   In the event of a dispute, entries made by Internet will be declared made by the Authorized Account Holder of the e-mail address submitted at time of entry.  "Authorized Account Holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or other organization (e.g. business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.

24.   This Contest is governed by the laws of Ontario and the laws of Canada applicable therein, and is subject to all applicable federal, provincial and municipal laws and regulations.

25.   By entering this Contest, the entrant agrees that the courts of the Province of Ontario, Canada shall have jurisdiction to entertain any action or other legal proceedings based on any provision of these Contest Rules and Regulations or the running of this Contest. The entrant hereby irrevocably attorns to the exclusive jurisdiction of the courts of the Province of Ontario.
